These Terms and Conditions govern all purchases made through essey.com. By placing an order, you agree to them. Please read them. They are written to be understood.
1. Who we are
Essey is operated by Essey s.r.o., with its registered address at Budimerice 124, 288 02 Budimerice, Czech Republic. Contact: love@essey.com / +420 608 000 052.
2. Scope
These Terms apply to all orders placed through essey.com. They do not apply to purchases made through third-party retailers or physical showrooms — for those, the terms of the respective point of sale apply.
Where these Terms distinguish between consumers and businesses, the following definitions apply:
Consumer (B2C): any natural person purchasing for purposes outside their trade, business, or profession.
Business customer (B2B): any legal entity or natural person purchasing in connection with their trade, business, or profession.
Where no distinction is made, the term applies to both.
3. Orders
An order placed on essey.com constitutes an offer to purchase. The contract is formed when we send you an order confirmation by email. We reserve the right to decline any order — for example, if a product is unavailable, if there is an error in pricing, or if we are unable to verify payment.
For made-to-order and custom colour items, production begins upon confirmation. These orders cannot be cancelled once confirmed.
All orders are subject to product availability. If an item becomes unavailable after your order is placed, we will contact you promptly and arrange a full refund.
4. Prices
All prices shown on essey.com are in the currency displayed at checkout and include VAT where applicable.
For customers located outside the European Union: prices shown do not include import duties, customs fees, or local taxes. These charges are the responsibility of the recipient and are determined by the customs authority of the destination country.
We reserve the right to correct pricing errors. If a pricing error affects your order, we will notify you before processing and give you the option to proceed at the correct price or cancel.
5. Payment
We accept the following payment methods:
— Credit and debit card (Visa, Mastercard, and others) — PayPal — Bank transfer — Online payment via our secure payment gateway (Global Payments or equivalent)
Payment is due at the time of order. For bank transfers, your order will be processed once payment is received and confirmed. Orders are not reserved until payment clears.
All transactions are processed through encrypted, secure connections. We do not store card details.
6. Delivery
Estimated delivery times are shown on each product page. Once your order has been dispatched, you will receive a tracking number by email.
Delivery times are estimates. We are not liable for delays caused by carriers, customs authorities, or circumstances beyond our control.
For made-to-order items, production time is additional and is indicated at the time of purchase.
Risk of loss passes to you upon delivery. For B2B customers, risk passes upon handover to the carrier.
Shipping costs are calculated at checkout based on your delivery address. For large or multiple-piece orders, contact us before ordering — we can often arrange more favourable conditions.
7. Returns
Consumers (B2C)
You have the right to withdraw from your purchase within 14 days of delivery, without giving a reason. To exercise this right, notify us at oops@essey.com within the 14-day window.
Items must be returned unused, unassembled, and in their original packaging to:

Return shipping costs are the responsibility of the consumer, unless the item is faulty or incorrect — in which case we cover the return in full.
Refunds are issued to the original payment method within 14 days of receiving the returned item. Original shipping costs are not refunded.
The right of withdrawal does not apply to:
— Made-to-order and custom colour items produced specifically for you — Items that have been used, assembled, or damaged after delivery — Items returned without their original packaging
Business customers (B2B)
The statutory right of withdrawal does not apply to B2B purchases. Returns may be accepted at our discretion. Where a return is agreed, store credit will be issued — not a cash refund. Contact us at oops@essey.com to discuss.
8. Warranty
Consumers (B2C)
Every Essey product is covered by a 24-month warranty from the date of purchase, covering defects in materials and workmanship. If a fault arises within this period, we will repair or replace the affected part or product.
The warranty does not cover: normal wear and tear, damage caused by misuse or improper handling, damage resulting from failure to follow care instructions, or modifications made after purchase.
To make a warranty claim, contact love@essey.com with proof of purchase and a description of the fault.
Business customers (B2B)
A 12-month warranty applies to B2B purchases, under the same terms as above. The statutory limitation of liability for business customers applies.
9. Liability
We are liable without limitation for damages caused by intent or gross negligence, and for damages resulting from injury to life, body, or health.
For all other damages, our liability is limited to the foreseeable damage typical for the type of contract.
We are not liable for indirect or consequential damages, including loss of profit or business interruption, unless caused by intent or gross negligence.
For B2B customers, all further liability — except as required by mandatory law — is excluded.
10. Intellectual property
All content on essey.com — including images, text, product designs, and the Essey trademark — is the property of Essey or its licensors. Nothing on this site may be reproduced, distributed, or used commercially without our prior written consent.
11. Dispute resolution
Consumers (B2C)
These Terms are governed by the laws of the European Union and, where applicable, the consumer protection laws of your country of residence. If a dispute cannot be resolved directly, you have the right to contact the relevant national consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Business customers (B2B)
These Terms are governed by Czech law. The courts of the Czech Republic have exclusive jurisdiction for any disputes arising from B2B transactions.
12. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time of your order applies to that order. Current Terms are always available at essey.com.
